License

Unless otherwise stated, Salesably and/or its licensors own the intellectual property rights for all material on Salesably, including but not limited to AI models, datasets, and tools. All intellectual property rights are reserved. You may view and/or print pages from Salesably for your own personal use subject to restrictions set in these terms and conditions.

Use of AI Training Tools

The AI training tools provided by Salesably are designed to assist sales professionals in enhancing their skills. However, Salesably does not guarantee any specific results or outcomes from using these tools. Users are responsible for applying the training in their professional context and should use their own judgment in doing so. Variability in outcomes is expected due to the diverse contexts in which the tools may be applied.

Users agree to use the AI training tools at their own risk. Salesably is not responsible for any decisions made or actions taken based on the training or guidance provided by these tools.

Call Recording and Conversation Analysis

Salesably offers features that enable recording and analysis of sales calls conducted through video conferencing platforms. By using these features, you acknowledge and agree to the following:

Recording Consent Responsibility: You are solely responsible for obtaining all necessary consents and permissions from all participants before recording any call. Recording laws vary significantly by jurisdiction—some require consent from all parties (two-party consent states/countries), while others require consent from only one party. It is your responsibility to understand and comply with all applicable recording laws in your jurisdiction and the jurisdictions of all call participants.

Indemnification: You agree to indemnify, defend, and hold harmless Salesably, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your failure to obtain proper consent for call recording or your violation of any applicable recording laws.

Disclaimer: Salesably does not provide legal advice regarding recording consent requirements. We strongly recommend consulting with legal counsel to understand your obligations under applicable law. Salesably is not responsible for any legal consequences resulting from your use of call recording features without proper consent.

Deal Clinic and Deal Analysis Services

Deal Clinic provides AI-powered analysis of sales conversations and deal information to generate diagnostic reports and recommendations. By using Deal Clinic, you acknowledge:

• AI-generated insights are provided for informational purposes only and should not be the sole basis for business decisions.
• The accuracy of analysis depends on the quality and completeness of information you provide.
• Salesably does not guarantee any specific sales outcomes based on Deal Clinic recommendations.
• Deal reports may contain confidential business information and should be treated accordingly.

You are responsible for ensuring that any information you submit to Deal Clinic (including call transcripts, notes, and deal details) does not violate any confidentiality obligations you may have to third parties.

CRM Integrations

Salesably offers integrations with third-party CRM platforms, including HubSpot and Pipedrive. By connecting your CRM account to Salesably:

• You authorize Salesably to access, retrieve, and process data from your CRM account as necessary to provide our services.
• You represent that you have the authority to grant such access and that doing so does not violate any agreements with your CRM provider or any third parties.
• You acknowledge that Salesably may write data back to your CRM (such as notes, activities, or updates) when you explicitly authorize such actions.
• You are responsible for the accuracy of data in your CRM and any data you choose to synchronize with Salesably.

Salesably is not responsible for any data loss, corruption, or issues arising from CRM synchronization. We recommend maintaining regular backups of your CRM data.

Third-Party Services

Salesably utilizes third-party services to provide certain features, including but not limited to Recall.ai for call recording, and various AI model providers for analysis and coaching. By using Salesably:

• You acknowledge that your data may be processed by these third-party services in accordance with our Privacy Policy.
• You agree that Salesably is not liable for any interruptions, errors, or issues caused by third-party service providers.
• Third-party services are subject to their own terms of service and privacy policies, which may apply to your use of features that rely on those services.

We select our service providers carefully and maintain appropriate agreements to protect your data. However, we cannot guarantee the performance or availability of third-party services.

Data Usage

By using our services, you agree that Salesably may collect, store, and use data generated from your interactions with our platform. This data may include, but is not limited to, input data provided by users, call recordings, transcripts, deal information, interaction logs, and performance metrics.

Salesably does not use your data to train AI models. Your content is used solely to provide and deliver our services to you. We do not use your conversations, recordings, transcripts, deal data, or any other content to train, improve, or develop artificial intelligence or machine learning models—whether our own or those of any third party.

We have contractual agreements with our AI service providers (including OpenAI and Anthropic) that prohibit them from using your data for model training. To the best of our knowledge and based on these agreements, your data is processed only to generate immediate responses and is not retained or used by these providers for any other purpose.

We ensure that any use of your data will be in compliance with our Privacy Policy and applicable data protection laws.

Data Deletion

You have the right to request the deletion of your personal data at any time. To request the deletion of your data, please contact us at support@salesably.ai. We will process your request in accordance with our Privacy Policy and applicable data protection laws.

AI-Generated Outputs

The outputs generated by Salesably's AI training tools are provided for your use in improving sales performance. These outputs, while generated based on your input, are the property of Salesably. However, you are granted a non-exclusive, non-transferable license to use the AI-generated outputs for your internal business purposes.

You agree not to use the AI-generated outputs in any manner that infringes upon the intellectual property rights of Salesably or any third party. Any commercial use or distribution of the AI-generated outputs requires prior written consent from Salesably.

Feedback

Customer hereby grants Salesably a perpetual, irrevocable, worldwide license to use any Feedback (as defined below) Customer communicates to Salesably during the Term, without compensation, without any obligation to report on such use, and without any other restriction. Salesably's rights granted in the previous sentence include, without limitation, the right to exploit Feedback in any and every way, as well as the right to grant sublicenses. Feedback will not be considered Customer's Confidential Information. ("Feedback" refers to any suggestion or idea for modifying any of Salesably's products or services, including without limitation all intellectual property rights in any such suggestion or idea.)

Personal information included in Feedback will be handled in accordance with our Privacy Policy.

Prohibited Activities

Users are strictly prohibited from engaging in any activities that compromise the security, integrity, or functionality of Salesably's systems. This includes, but is not limited to:

• Hacking or attempting to hack into any part of the system.
• Reverse engineering any part of the system or its components.
• Performing prompt injection attacks or any other form of code injection.
• Using automated tools or scripts to access or interact with the system in unauthorized ways.
• Any other activities that interfere with or disrupt the normal operation of the system.

Violations of this policy may result in immediate termination of access to Salesably's services and may be subject to legal action.

If you are a California resident, you may have certain rights under the California Consumer Privacy Act (CCPA) and other California laws. Please see our Privacy Policy for more information on these rights and how to exercise them.
